A clear agreement for creating and selling on Dezajn: who owns the work, where else you may sell it, how products reach customers, how earnings and payouts work, and what happens when something goes wrong.

The essentials

These quick answers are a guide to the agreement, not a replacement for the full terms below.

Your work stays yours

You keep ownership of your original designs. You give Dezajn a non-exclusive licence only to operate, promote, produce, and sell your Dezajn products.

You can sell elsewhere

The relationship is non-exclusive. You may use and sell your designs on your own site and on other marketplaces, subject to any third-party rights.

You choose your earnings

The amount shown as your earnings when a product is published is recorded per item sold. Actual payout remains subject to completed delivery, refunds, and adjustments.

Payouts follow delivery

Eligible earnings normally become withdrawable seven days after recorded delivery. Withdrawals require a verified, payout-enabled Stripe Connect account.

1. Who these terms are between

These Designer Terms form an agreement between you, the person or business using Dezajn's designer features, and Ladislav Hájek, operating as Dezajn. They apply when you create or convert a designer account, upload content, publish a product, or earn money through Dezajn.

By accepting these terms, you confirm that you are at least 18 years old and can enter a binding agreement. If you act for a company or another person, you confirm that you have authority to bind them. The Privacy Policy, DSA Notice & Action rules, and any product-creation rules presented in the service also apply where relevant.

2. How the marketplace relationship works

Dezajn provides creation tools, product configuration, marketplace discovery, buyer checkout, payment collection, production coordination, fulfilment support, customer service, and designer payout infrastructure. Acceptance of a design or publication of a product does not create employment, partnership, agency, franchise, or joint ownership between you and Dezajn.

Dezajn is the seller to the buyer. Buyer orders made through Dezajn are concluded with Ladislav Hájek, not with the individual designer. Dezajn sets and administers the buyer-facing sales terms, collects payment, arranges production and fulfilment, and handles buyer refunds and complaints. You contribute licensed creative content and receive creator earnings under these terms.

3. Ownership of your designs

As between you and Dezajn, you retain ownership of the original intellectual-property rights in content you create and upload, including artwork, graphics, product names, descriptions, and brand elements. These terms do not transfer ownership of your original design to Dezajn.

You are responsible for keeping your source files and evidence of authorship or permission. Dezajn is not a copyright registry and cannot determine ownership merely because a file was uploaded first.

4. The licence you give Dezajn

You give Dezajn a worldwide, non-exclusive licence to host, store, reproduce, resize, crop, colour-process, display, distribute, advertise, create product mockups from, print or otherwise apply your content to products, and sell and fulfil those products. Dezajn may sublicense these limited rights to production partners, hosting providers, payment providers, marketing channels, and other suppliers only as needed to operate the service and complete sales.

This licence begins when you upload content. For drafts, it lasts while the draft remains in your account. For published products, it lasts while the product is listed and for a reasonable wind-down period afterwards so Dezajn can complete existing orders, handle returns, preserve transaction evidence, and comply with law. Promotional material already distributed does not have to be recalled, but Dezajn will stop creating new campaigns around a removed product after a reasonable operational period.

Dezajn may make technical changes needed for production or display but will not knowingly claim authorship of your original work or materially redesign it for a new product without your permission.

5. Selling your work elsewhere

You are free to sell, license, publish, and promote your original designs anywhere else. There is no exclusivity obligation and no requirement to offer Dezajn the same price or conditions that you use elsewhere.

That freedom covers your underlying design, not assets that belong to someone else. You may not copy Dezajn's product mockups, templates, software, marketplace data, trademarks, supplier assets, or buyer information for another store unless Dezajn or the relevant rights owner gives permission. Removing a product from Dezajn does not cancel an order already placed.

6. What you promise about uploaded content

You promise that:

  • you created the content or have all permissions needed for Dezajn to use it as described here;
  • the content does not infringe copyright, trademark, design, publicity, privacy, or other rights;
  • any people, brands, locations, or third-party material shown in the content are used with the necessary releases or licences;
  • the content and product information are not unlawful, deceptive, defamatory, hateful, exploitative, sexually abusive, threatening, or designed to facilitate harm;
  • you will not upload malware, manipulate engagement, impersonate another person, or use the service for fraud; and
  • information you provide about yourself, your business, tax status, and payout account is accurate and kept current.

AI-assisted content is allowed only when it follows the same rules. Using an AI tool does not guarantee that you own the result or that the result is safe to sell. You remain responsible for reviewing it and securing any necessary rights.

7. Product approval, availability, and pricing

A submitted product may be checked automatically and/or by a person for production quality, rights risk, safety, and marketplace policy. Dezajn may reject a submission, request changes, limit the countries or product variants in which it is offered, or remove it later. Publication is not guaranteed.

Product pricing combines operational amounts controlled by Dezajn with the creator-earnings amount available to you in the creation flow. The buyer's final price can also reflect currency, tax, shipping, discounts, and regional costs. The creator-earnings amount recorded for a qualifying order item is the amount shown for that product and currency when the order is placed. Dezajn will show material pricing or earnings changes before they apply to new orders; they do not retroactively reduce earnings already recorded for a valid order except through the adjustments described below.

8. Discovery and ranking

Publishing makes a product eligible for discovery; it does not guarantee a particular position, audience, number of impressions, or sales. Marketplace ranking and recommendations may consider product readiness and regional availability, recent views, favourites and cart activity, freshness, sales or conversion signals, Drop Arena results and reliability, creator and category diversity, and a signed-in visitor's interests. Engagement and relevance generally carry more weight than any single signal, while freshness and diversity help newer work receive exploration opportunities.

Dezajn may feature or curate products for editorial, seasonal, safety, quality, or promotional reasons and may test or update ranking systems. Fraudulent or manipulated activity may be ignored and may lead to reduced distribution or suspension. Dezajn does not promise that ranking inputs will remain unchanged or disclose details that would make manipulation or security abuse easier.

9. How designer earnings are calculated

Designer earnings are the creator amount recorded for each qualifying item sold, multiplied by the quantity. They are not the full buyer payment and do not include Dezajn's base price, shipping, collected taxes, or amounts earned by other designers. Your dashboard is the primary record of pending, available, reserved, adjusted, and transferred balances.

Estimates shown before an order are not a promise of income. An earning arises only from a successfully paid, valid order allocated to your product. Currency conversion may be required when the order currency, configured creator amount, wallet balance, and payout currency differ; reasonable current exchange-rate data and currency rounding may be used.

10. Pending period and release

A qualifying earning first appears as pending. Under the current release schedule, it normally becomes withdrawable seven days after the fulfilment provider records delivery. A delivery problem, refund, chargeback, fraud review, payment-integrity issue, rights complaint, sanctions check, or other unresolved risk may delay or prevent release.

A pending balance is an account record, not money held in a bank account for you, and it is not available for withdrawal until released. Dashboard dates are estimates when they depend on fulfilment or third-party information.

11. Withdrawals and Stripe Connect

To receive a payout, you must accept the current Designer Terms, complete Stripe Connect onboarding, pass required identity and eligibility checks, add a valid payout method, and keep payouts enabled. Stripe's own connected-account terms and privacy notice also apply to its services.

You may request withdrawal of eligible funds through the wallet. The current minimum for a combined converted payout is one unit of the selected payout currency. Dezajn may process different source-currency balances separately, convert them for the payout summary, review a request before approval, and prevent overlapping withdrawal requests for the same source currency. Exchange-rate differences, bank processing time, Stripe availability, supported-country rules, and third-party fees may affect the final timing or amount received. The interface will show applicable information available to Dezajn before or during the request.

12. Refunds, reserves, reversals, and negative balances

Dezajn may cancel pending earnings or debit available balances when the related order is cancelled, refunded, charged back, fraudulent, duplicated, not fulfilled, calculated incorrectly, or affected by a rights claim or payment dispute. Dezajn may also place a reasonable reserve or pause withdrawals while a specific risk is investigated.

Adjustments should correspond to the affected transaction or reasonably expected loss. Dezajn may offset a negative balance against future earnings or other amounts owed to you. If that is insufficient, Dezajn may request repayment where permitted by law. You can report a wallet discrepancy through the support tools in your billing area or contact the support address below.

13. Taxes and payout records

You are responsible for determining and reporting taxes, social contributions, registrations, and business obligations arising from your creator earnings, except where Dezajn or a payment provider must withhold or report under mandatory law. You must provide requested tax and identity information and promptly correct it when it changes.

Dezajn may issue wallet statements, payout confirmations, tax statements, or correction records. These describe the marketplace payout relationship and do not by themselves reclassify you as an employee or make you the seller in the buyer transaction. Keep your own records and obtain professional advice for your circumstances.

14. Data access and buyer information

Your account may provide access to your profile, products, product activity, aggregated performance, order-linked creator earnings, wallet entries, withdrawals, and statements. Dezajn has access to content and account data you provide and to operational data generated through creation, discovery, sales, support, moderation, and payouts, as described in the Privacy Policy.

Because Dezajn is the buyer-facing seller, designers do not receive buyers' full payment credentials and generally do not receive their contact or delivery details. Any buyer information made available for a specific support purpose may be used only for that purpose and may not be copied, marketed to, or used to move a transaction outside Dezajn.

15. Moderation, reports, and appeals

Dezajn may use automated checks and human review to detect suspected infringement, illegal content, unsafe material, manipulation, or other breaches. Action may include reduced visibility, rejection, delisting, account restrictions, evidence preservation, or payout holds connected to the issue.

Where required, Dezajn will explain a restriction and provide an opportunity to challenge it, unless doing so is prohibited by law or would compromise safety, fraud prevention, or an investigation. You may report illegal content or appeal a moderation decision through the DSA Notice & Action page. You must cooperate with reasonable requests for proof of rights or identity.

16. Closing or suspending an account

You may end the relationship by unpublishing your products and deleting your account in Settings. Before doing so, withdraw eligible funds and download records you need. Account deletion does not cancel open orders, unresolved disputes, repayment duties, or legal record-retention requirements.

Dezajn may restrict, suspend, or terminate designer access for a material or repeated breach, fraud, sanctions or identity issues, serious customer harm, legal risk, security threats, manipulated engagement, or prolonged inability to fulfil platform requirements. Where applicable law requires notice or reasons, Dezajn will provide them. Immediate action may be taken where necessary to protect buyers, rights holders, the platform, or the public.

After termination, public listings may be removed and your access to account data may end. Dezajn may retain transaction, payout, moderation, security, and legal records for the periods described in its privacy and retention practices. Sections that by their nature must continue—including licences needed for order wind-down, adjustments, tax, liability, disputes, and record keeping—survive termination.

17. Changes to these terms

Dezajn may update these terms for new features, operational changes, clearer drafting, risk controls, or legal requirements. Material changes will be announced through the service or by email with reasonable advance notice. Where the EU platform-to-business rules apply, Dezajn will provide at least 15 days' notice, and more when a change reasonably requires significant technical or commercial adjustment.

Advance notice may be shorter where a change is legally required or addresses an unforeseen and imminent danger such as fraud, malware, spam, a data breach, or another cybersecurity risk. Changes are not retroactive unless required by law or beneficial to designers. If re-acceptance is requested, designer selling or payout features may remain paused until you accept the new version.

18. Service availability and responsibility

Dezajn does not guarantee uninterrupted access, permanent storage, acceptance of any product, marketplace placement, sales volume, or income. Features, suppliers, supported products, regions, and currencies may change. Nothing in these terms excludes rights or liabilities that cannot legally be excluded, including liability for intentional misconduct, gross negligence, or injury where applicable law does not permit a limitation.

You are responsible for losses and reasonable third-party costs caused by your fraud, deliberate misconduct, material breach of these terms, or content that infringes another person's rights. Dezajn will give you reasonable notice of a covered claim and will not agree to an unreasonable settlement at your expense without consulting you.

19. Governing law and disputes

These terms are governed by the laws of the Czech Republic, without depriving you of mandatory protections that apply in your country. The parties should first try to resolve a dispute through support in good faith. If it cannot be resolved, the competent courts of the Czech Republic will have jurisdiction unless mandatory law provides otherwise.

Nothing here prevents either party from seeking urgent protective relief, making a report to a regulator, or using another complaint, mediation, or court route that cannot lawfully be restricted.
